1 Scope
(1) The following terms of use apply to all contracts for apps and plugins between us, audriga GmbH, Alter Schlachthof 57, 76131 Karlsruhe, Germany ("audriga"), and you as our customer. The use of the apps is permitted only for commercial customers; consumers are not allowed to use them.
(2) The version of the terms of use valid at the time of contract conclusion is authoritative.
(3) If you have your own general terms and conditions, they do not apply.
2 Services
(1) We provide you with the software for free use. The functional scope of the respective current version of the software is outlined in the Technical Service Description.
(2) By downloading, you receive the software as an executable program. The source code of the software is not part of the contract.
(3) The use of the software is at your own risk. Claims for warranty and liability are excluded, for example, due to errors in data representation or in creating the QR code.
(4) We reserve the right to change the functional scope of the software as needed or to discontinue its operation entirely. Adjustments to these terms of use are possible at any time.
3 Conclusion of the Contract
(1) The presentation of the software for download on our website or in a marketplace is a legally binding offer from our side.
(2) A contract between you and us is concluded as soon as you use the downloaded and installed software.
(3) The only language available for the conclusion of the contract is German. Translations of these terms of use into other languages are for your information only. In case of any discrepancies between language versions, the German text prevails.
4 Copyright and Usage Rights
(1) The software is subject to our copyright. We grant you the revocable, non-exclusive, and non-transferable right to use the software as intended.
(2) You are liable for all damages that arise for us from a violation of copyright.
5 Usage Requirements
You ensure that you meet the technical and legal requirements to use the software. The system requirements of the current version of the software can be found in the Technical Service Description.
6 Data Protection
We comply with legal data protection regulations when processing your personal information. This also includes technical security measures adapted to the current state of technology (Art. 32 GDPR) and the obligation of employees to maintain data confidentiality (Art. 28 para. 3 lit. b GDPR).
7 Final Provisions
(1) German law applies.
(2) The exclusive place of jurisdiction is Karlsruhe.
(3) Should any of the above provisions be or become invalid, or should a necessary provision be missing, the validity of the remaining provisions is not affected. We strive to find an amicable regulation with you in this case.
